Uttarakhand High Court Upholds Deployment of Diploma Engineers in Kedarnath Yatra

Uttarakhand High Court: Kedarnath Yatra: Diploma engineers deployment: Pilgrim safety: In a significant legal decision the Uttarakhand High Court at Nainital upheld the deployment of diploma engineers during the 2026 Kedarnath Yatra and dismissed the appeal filed by the Uttarakhand Diploma Engineers Federation. The federation had challenged the government order arguing that diploma engineers in the Public Works Department and Irrigation Department were being assigned tasks beyond their technical scope. However the division bench comprising Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay found no merit in the contention and ruled that the engineers were not assigned sanitation duties as alleged. The court clarified that the state government has the constitutional and administrative authority to assign duties to its employees in public interest and according to service exigencies and dismissed the appeal outright.

Clarifying Assigned Responsibilities

The court closely examined the government order dated April 5 2023 and noted that diploma engineers were tasked with crucial technical responsibilities essential for ensuring the safety and convenience of pilgrims along the treacherous Kedarnath Yatra route. Their duties included monitoring and preventing landslides maintaining footpaths conducting emergency technical inspections and carrying out repair and maintenance work on critical portions of the pilgrimage route. These tasks were found to be directly linked to the safe movement of devotees and consistent with the engineering expertise of the deployed personnel. In contrast sanitation related work was clearly allocated to Sulabh International municipal bodies and local civic authorities which the petitioners failed to disprove with any documentary evidence.

Government Authority and Public Interest

The bench emphasised that in the context of the massive inflow of pilgrims visiting Kedarnath each year the state government is obligated to mobilise all necessary administrative and technical resources to protect life and ensure public safety. The High Court reiterated that government servants must discharge duties assigned to them in accordance with service rules and organisational requirements when such assignments are made to serve the larger public interest. By endorsing the government order and dismissing the federation’s appeal the court reinforced the principle that administrative discretion in deployment of officers is a foundational aspect of public service governance especially during large scale events like religious yatras.
